Counsel – China



Reporting functionally to the Regional Counsel for Abbott International, Russia, India and China, you will be based in Shanghai and act as the country's second Counsel for legal matters affecting the PRC. You will provide commercial legal advice and counseling for Abbott International's pharmaceutical business in the PRC, and also support its non-pharmaceutical businesses such as diagnostics, vascular, diabete care, molecular, medical optics, and reserach and development which are growing rapidly in China.

 


Core Job Responsibilities:


You will analyze and provide legal advice based on business-oriented solutions to local senior management and the sales team on a variety of matters including litigious issues, anti-trust and trade regulations, labor and industrial disputes, government investigations and compliance. You will also be responsible for preparing and negotiating various commercial agreements such as distribution, co-promotion, in-licensing, marketing and sales, acquisition and divestiture.




You must be able to resolve routine and moderately complex to complex legal matters in practice area with minimal supervision. You are expected to gain solid knowledge of Abbott’s businesses and knowledge of the broader business impact of decisions made; and changes in laws that affect business areas. You will represent Abbott externally to customers, suppliers, competitors or government agencies, resolve legal issues using negotiation skills and legal expertise as well as coach and assist sales and marketing teams in executing business strategies where specific technical expertise is required, select and direct.  You will also supervise work of the outside counsel, define project objectives and manage projects.


Requirements:




You should have a minimum of 8 to 10 years' relevant experience in an international law firm and/or multinational corporation. Experience in Corporate and Commercial Law and Direct Foreign Investment Laws is essential.


Good understanding and experience in Intellectual Property (patents, trademarks), Company Law, Consumer Protection Law, Competition Law, FCPA/Criminal Law/Anti-bribery Law, Ethics and Compliance, local requirements and Labor Laws are desirable.


You should be highly motivated and enthusiastic with demonstrated initiative, adaptability and integrity. Strong communication skills in Mandarin and English,  cultural sensitivity to working in a multi-national company and the ability to work effectively in teams are a prerequisite.
